Renting out your Italian home, properly

Four long-term contracts, a 30-day rule, a national code and a flat tax that non-residents can use. What letting an Italian property actually involves, as of 2026.

You bought the place. For much of the year it stands empty, and at some point the thought arrives: it could earn its keep. Italian tenancy law will oblige — through a system that looks baroque from the outside and is, once you know the four boxes, reasonably orderly. Here is the map: the long-term contracts, the short-let rules (tightened considerably since 2025), the flat tax that makes the arithmetic work, and what changes when the owner lives abroad. Which is, presumably, you.

One decision before all the others

Everything follows from a single line in the law: is the stay over or under 30 days?

Over 30 days, you are in the world of registered residential tenancies, governed since 1998 by Law 431. Under 30 days — provided you remain a private individual rather than a business — you are in the world of locazioni brevi, short lets: no contract registration, but a national identification code, mandatory safety equipment and police reporting instead. Both worlds function. They reward different owners.

The long-term contracts, in four boxes

The 4+4. Rent freely negotiated; minimum four years, renewing automatically for four more. At the first expiry you may decline renewal only for reasons the law lists exhaustively — moving in yourself or close family, selling, substantial renovation — with six months' notice by registered letter. At year eight, either side may walk away, again on six months' notice. The tenant, meanwhile, may leave at any point for serious reasons — on six months' notice. Stable, and slow to unwind. Know that before signing, not after.

The 3+2. The rent sits within bands fixed by a local agreement between landlord and tenant associations, and the contract needs a certificate of conformity from one of the signatory organisations. Three years, plus two by right. Why cap your own rent? Tax. Trieste is on the national list of "high housing tension" municipalities — so, usefully, are Muggia and Duino Aurisina — which means concordato income qualifies for the 10% flat tax instead of 21% (as of 2026), and Trieste's local property tax (ILIA) falls from 1.06% to 0.65% on a concordato-let home (2026 rates). The running-cost side of that equation is in owning property in Trieste, year after year.

The transitorio. For documented temporary needs — a work posting, a course — up to 18 months. There is no statutory minimum, whatever the internet insists. The need must be stated in the contract; if it is missing, the law quietly converts the whole thing into a 3+2. Which concentrates the mind.

The student contract. Six months to three years, available only in university towns, to students resident elsewhere. Trieste — the University, SISSA — qualifies comfortably.

Long-term contracts are registered with the tax agency (form RLI); the flat-tax election is made at that moment.

Short lets: under 30 days

No registration of the contract. That is where the simplicity ends. As of 2026, the checklist reads:

  • CIN. Since 1 January 2025, every unit offered for short lets needs a Codice Identificativo Nazionale from the national tourism database, displayed outside the property and quoted in every listing. Operating without one: €800 to €8,000. Failing to display or quote it: €500 to €5,000 per unit.
  • Safety kit. Working gas and carbon-monoxide detectors, plus portable extinguishers — one per 200 square metres of floor, at least one per storey. Fines from €600 to €6,000.
  • Guests reported. Guest identities go to the police via the Alloggiati Web portal within 24 hours of arrival — six hours if the stay is under a day. And since a Council of State ruling of November 2025, identity must genuinely be verified: a key box and a shrug no longer suffice, though remote devices at the door are allowed if they match face to document.
  • The business line. From 1 January 2026, letting more than two apartments short-term in a tax year is presumed to be a business: VAT number, a formal filing with the municipality, and no more flat tax. Two units is the ceiling of the private regime.

A short let may include linen, cleaning and wi-fi. Add breakfast or car hire and you have become, in the law's eyes, a hospitality operation — a different licence, and a different article.

The flat tax, precisely

The cedolare secca is why Italian landlords sleep at night: one substitute rate on the rent, replacing income tax, the regional and municipal surcharges, and the registration and stamp duties on the contract. Flat, final, and reserved for private individuals. The rates, as of 2026:

One footnote for Trieste: a transitorio here follows the agreed bands in any case, and one drawn up to conform with the local agreement pays the 10%, not the 21%.

Where a platform or agent collects the rent for you, it withholds 21% on account.

A worked example. A Trieste flat let at €1,000 a month — €12,000 a year. On a 4+4 at the flat 21%: €2,520 of Italian tax (2026). The same flat on a 3+2 — assuming €1,000 sits within the agreed band for that street and size — pays €1,200, and enjoys the kinder ILIA rate on top. The concordato trade is a ceiling on rent in exchange for markedly less tax; whether it wins depends on where the band sits against the market. Arithmetic worth doing before choosing. You live abroad. Where does this get taxed?

In Italy, first. Rental income from Italian property is taxable in Italy regardless of where the owner lives. You will need an Italian tax code and a non-resident tax return — the Modello Redditi, with its section for non-residents. The agreeable part: the flat tax is fully available to non-residents; the law asks nothing about where the landlord sleeps (as of 2026).

Your home country will usually also want to hear about it. Most double-taxation treaties let both states tax rental income from Italian property, with your country of residence granting a credit or an exemption. One honest caveat: a substitute flat tax is not automatically creditable everywhere — some jurisdictions take a narrow view.
