Buying in Italy from Austria: the land registry will feel like home
Trieste kept the Habsburg land registry: the tavolare system IS the Grundbuch. What changes is everything around it — the broker's fee cap you are used to, the Treuhand closing, and a purchase tax that is often lower than Austrians expect.
If you are buying from Vienna or Graz, here is the one fact that surprises every Austrian buyer in Trieste: the land registry works exactly like yours. Trieste, Gorizia, Trento and Bolzano never abandoned the Habsburg Grundbuch — Italian law calls it the sistema tavolare (R.D. 499/1929), and just like at home the entry in the register is what transfers ownership, with a court supervising every entry. In the rest of Italy registration is declarative; here it is constitutive. Your instincts are correct in this city.
Who does what: Treuhänder vs notaio
In Austria the closing typically runs through a Treuhänder — a lawyer or notary holding the price in escrow until the Grundbuch entry is secured. In Italy the notaio is a public official: one deed (rogito), identity and title checks by the notary, and payment normally handed over at the deed itself, usually as a banker's draft or an irrevocable transfer. There is no standard escrow — the safety comes from the notary's checks and, in the tavolare provinces, from the court-supervised registration. The road to the deed has its own Italian rhythm: written offer (proposta), preliminary contract (compromesso, usually with a 10–20% deposit under penalty rules), then the deed. The broker's fee: no ImmMV here
Austria caps the agent's commission by regulation (around 3% plus VAT per side under the ImmMV). Italy has no statutory cap: the fee is contractual, customarily around 3–4% plus VAT from the buyer. We state ours openly on every listing — 4% plus VAT — together with the indicative tax figures, so there are no surprises at the deed.
Purchase tax: often lower than you fear
Austria's Grunderwerbsteuer is 3.5% of the price. In Italy, for resale homes bought from private sellers, the 9% registry tax applies to the cadastral value, not the price (the prezzo-valore rule) — and cadastral values in Trieste are typically far below market prices. The effective burden often lands below the Austrian 3.5%, which surprises most buyers. New builds instead carry VAT on the price. Every listing of ours shows the indicative figure for that specific home; for luxury cadastral categories (A/1, A/8, A/9) we show the ordinary regime, because first-home reliefs simply do not apply there.
Owning from abroad
Italy and Austria have a double-taxation treaty, and a second home in Italy means Italian property tax (IMU/ILIA in Trieste) plus declaration duties at home — this is where a tax adviser earns their fee, and we can introduce you to ours.
